Chertkov Academy Participant Agreement

1. Assumption of Risk & Release of Liability

In consideration of the fee paid and permission to participate in programs offered by Chertkov Academy (the “Academy”), I, the undersigned participant (or parent/guardian of a minor participant), understand and acknowledge that activities may involve physical exertion and inherent risks of injury, illness, or property damage. These risks include, but are not limited to, slips, falls, collisions, strains, sprains, overexertion, equipment failure, and risks arising from the actions or omissions of others.

With this knowledge, I voluntarily assume all such risks associated with my (or my child’s) participation and release, waive, and hold harmless the Academy and its owners, directors, officers, employees, instructors, contractors, volunteers, sponsors, promoters, operators, hosts, landlords, affiliates, members, participants, and agents (collectively, the “Released Parties”) from any and all losses, damages, liabilities, claims, demands, actions, or causes of action of any kind, known or unknown, arising out of or related to participation, instruction, observation, use of facilities/equipment, or travel to/from Academy activities, except to the extent caused by the gross negligence or willful misconduct of a Released Party where such exclusion is prohibited by law.

I further agree to indemnify and defend the Released Parties from any claims brought by, or on behalf of, the participant or any third party arising out of the participant’s involvement in Academy activities.

2. Rules, Safety & Conduct

I (or my child) agree to follow all instructions, safety rules, codes of conduct, and facility policies issued by Academy staff and instructors. The Academy may remove any participant from an activity for safety or misconduct reasons without refund.

3. Health & Medical Consent

I certify that I (or my child) am in good physical condition to participate and have disclosed any relevant medical conditions to the management by myself. I understand the Academy is not a medical provider and that only basic first aid may be administered on site. In the event of illness or injury, I authorize the Academy to obtain emergency medical care/transport as deemed necessary, and I accept responsibility for all associated costs.

4. Photo/Audio/Video Consent

Participant agrees that any pictures, audio, or visual recordings taken of him/her in connection with Chertkov Academy can be used for publication, promotion, articles, shows and advertisement without additional consent and without compensation at this time or any other time.

5. Payment & Refund Acknowledgment

I understand that fees are due as posted by the Academy. Unless otherwise stated in writing, fees are non‑refundable once a session begins, except where required by law or at the Academy’s sole discretion for medical or relocation reasons (documentation may be requested).

6. Acknowledgment, Governing Law & Severability

I have read and understand this agreement and agree to its terms. I am not under the influence of alcohol, drugs, or other intoxicants. If any provision is held invalid, the remainder remains in effect. This agreement is intended to be as broad and inclusive as permitted by applicable law and shall be governed by the laws of the Province of Alberta and the laws of Canada applicable therein, with venue in the courts of Alberta (unless otherwise required by law).
